18 U.S.C. §2257 Record Keeping Requirements Compliance Statement

The operator of HDPornVault.com (“HDPornVault”, “the Website”) is not the “producer” (whether primary or secondary as defined in 18 U.S.C. § 2257 and 28 C.F.R. Part 75) of any of the visual content (e.g., videos, images) found on HDPornVault.com that may be uploaded by third-party users in the future.

The operator’s activities with respect to such user-generated content, if and when user uploading functionality is enabled, will be limited to the transmission, storage, retrieval, hosting, and/or formatting of depictions posted by third-party users on areas of the Website designated for user content. HDPornVault.com does not direct, control, or have a direct financial interest in the creation of such third-party user-generated content beyond the general operation of the platform.

Please direct any request you may have regarding 18 U.S.C. § 2257 records in relation to any content found on HDPornVault.com directly to the respective uploader, producer, or account holder of that specific content (“Content Uploader”). As HDPornVault.com is not the producer of such content, we do not maintain the § 2257 records for content uploaded by third parties. Such records are the sole responsibility of the individuals or entities who produced and uploaded the content.

HDPornVault.com requires (as outlined in our Terms of Service) that all Content Uploaders abide by the following strict compliance procedures regarding content they may upload to the Website, if and when such functionality is available:

  • All Content Uploaders must be at least eighteen (18) years of age (or the age of majority in their jurisdiction, if older) and may be required to undergo an identity verification process by HDPornVault.com prior to being permitted to upload content.
  • Prior to uploading content, HDPornVault.com requires that all Content Uploaders provide evidence or certify that:
    • All individuals appearing in the visual depictions within their content are eighteen (18) years of age or older at the time the depictions were created (or the minimal age required to appear in such content by their State, jurisdiction, or Country if more than 18 years old).
    • All individuals depicted freely consented to participate in the content at the time of its production and have agreed to its upload on HDPornVault.com by the Content Uploader.
    • As the producer of said content, the Content Uploader certifies being fully compliant with all applicable record-keeping requirements under 18 U.S.C. § 2257 and 28 C.F.R. Part 75 for all content they upload to HDPornVault.com. This includes maintaining all required documentation, such as proof of age and identity for all performers, and model releases.
    • The Content Uploader agrees to provide such § 2257 documentation promptly to HDPornVault.com or its designated agents upon request.
    • The uploaded content does not violate HDPornVault.com’s Terms of Service, and any of its related policies, including but not limited to prohibitions against Child Sexual Abuse Material (CSAM) (as detailed in our Child Sexual Abuse Material Policy within the Terms of Service) or Non-Consensual Content (NCC) (as detailed in our Non-Consensual Content Policy within the Terms of Service).

Failure by a Content Uploader to adhere to these requirements may result in removal of content, account suspension or termination, and other actions as described in our Terms of Service.

This statement is intended to comply with the requirements of 18 U.S.C. § 2257 and 28 C.F.R. Part 75 with respect to the labeling and record-keeping requirements for producers of sexually explicit material. HDPornVault.com is committed to upholding the law and expects all users who may upload content in the future to do the same.
